1. Introduction

These SMR Booking Only terms and conditions (“ServiceTerms”) set out the rules which cover our relationship with you if you use SMR Booking Only (“the Service”).

The Service is made available via a webpage which you access by tapping “Book online” on a participating third party garage’s Google Maps listing.

These Service Terms explain our responsibilities and yours, and how you can use the Service. These are legally binding and apply to you if you have accessed the Service, so please read them. You may also want to print or save them in case you ever want to come back to them in the future.

If these Service Terms are inconsistent with our Caura Terms of Use, then these Service Terms will apply in relation to your use of the Service.

You should read these Service Terms along with our Caura Privacy Policy which explains how we use your personal information.

2. Who are we?

We are Caura Ltd (also referred to as “we”, “our” and “Caura”). We are registered in England and Wales under company number 11520538 and have our registered office at 1 Horse Guards Avenue, London, England, SW1A 2HU.

Caura is authorised and regulated by the Financial Conduct Authority (FCA) under registration 923662.

4. What is the Service?

SMR Booking Only (“the Service”) is a service powered by Caura which enables you to book a third-party car garage (the “Garage”) via that Garage’s Google Maps listing. Caura does not carry out work on your vehicle, and the Garage you choose to book into is responsible for any work carried out on your vehicle.

5. How the Service works

Requesting a Booking

By using the Service, you appoint Caura to request a booking on your behalf from the Garage. We will do this by communicating the required details (your vehicle registration number, requested date(s), and other booking details) with the Garage.

Where the Service is available, you will be able to tap “Book online” from a participating Garage’s Google Maps listing. This will open a booking journey where you will be asked to provide:

You can request a booking based on your availability, and the Garage will accept based on theirs. Caura does not guarantee Garage availability on your chosen dates.

Caura acts as your agent in this booking and we solely facilitate the submission of your booking request to the Garage. We do not perform work to your vehicle and we do not act on behalf of the Garage. If you experience any issues relating to work undertaken on your vehicle, you must first contact the Garage who did the work as they bear liability for the quality and standard of their work. Caura has no liability to you for any acts, omissions, damage, quality issues, errors, or defaults of the providers in connection with the Service.

When you submit a booking request, this is sent to the Garage. The Garage may:

No-Shows

To protect Garages from no-shows, when you request a booking, we ask you to provide and pre-authorise a payment card for us to hold on file. If your booking is confirmed by the Garage and you do not attend your booking, Caura reserves the right at our sole discretion to charge a no-show fee to the payment card you have provided. The amount we charge as a no-show fee may change from time to time and this will be clearly shown to you at the time you request a booking.

Using the Service

How you use the Service may vary slightly depending on the parking operator/provider and how the Apps display the feature, but typically you will:

Payment for Work Carried Out

Payment for the work carried out is paid on-site directly to the Garage. As already noted above, Caura does not take payment for the work carried out by the Garage. Caura bears no responsibility for any repairs recommended by a Garage nor the category of repair.

By using the Service you consent that Caura will collect, process, store, and transmit usage, engagement, and other data. Caura acts as data controller for your data. If you have any questions about the Service please contact support@caura.com.

Your Details

You do not need to register a Caura account to use this Service.

When you submit a booking request, you must provide accurate and up-to-date information (including your full name, email address, phone number, vehicle registration number, requested date(s), drop-off time and service type). If you provide incorrect, incomplete or misleading information, the garage may be unable to process or progress your booking, and may be unable to contact you about your booking.  In those circumstances, your booking may be delayed, not confirmed, cancelled, or treated as a no-show.

You must have the explicit consent of the registered keeper of any vehicle for which you are making a booking request (for example, if you are booking on behalf of someone else). You are responsible for ensuring you continue to have this consent and you may be required to evidence this consent at any time.

You must notify us promptly if you believe an unauthorised person has used your contact details or payment method in connection with a booking request made via the Service.

The Service is only available to you if you meet the following criteria:

6. Changes to these Service Terms

We may amend these terms from time to time, for example, to reflect changes in law or the functionality of the Service. We will notify changes to these terms in advance by updating the terms published for the Service. Your continued use of the Service will confirm your acceptance of the revised terms. Please check the terms whenever you use the Service to ensure you understand the terms that apply at that time.

7. Privacy

Under data protection legislation, we are required to provide you with certain information about who we are, how we process your personal data and for what purposes, your rights in relation to your personal data, and how to exercise them. This information is provided in our Caura Privacy Policy and it is important that you read that information.

Please be aware that internet transmissions are never completely private or secure and that any message or information you send in connection with the Service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

8. Licence Restrictions

The Service is made available on a non-exclusive, non-transferable basis for your personal, non-commercial use only. This means that you cannot make money from your use of the Service.

You agree that you are solely responsible for any costs and expenses you may incur in relation to your use of the Service.

10. Intellectual Property

All intellectual property rights in the Service throughout the world belong to us (or our licensors) and the rights are licensed (not sold) to you. You have no intellectual property rights in, or to, the Service other than the right to use it in accordance with these Service Terms.

You license us to use any information, data or other content (“Content”) you provide to us or that we obtain or receive on your behalf and you agree that we can use, modify, display, distribute and create new material using the Content so that we may provide you with the Service and for any other purposes set out in these Service Terms, including our Caura Privacy Policy.

By submitting Content you confirm and agree that the owner of that Content has expressly agreed that, without any particular time limit, and without the payment of any fees, we may use the Content for the purposes set out in these terms and our Caura Privacy Policy.

All trade marks appearing within the Service (for example OEM logos) are the property of their respective owners and their appearance in no way implies any affiliation with the owners.
